Trump hating NY Judge will hand down his sentence this week

Jay Weber Show transcript 1-6-25

There is ‘less here’ than meets the eye with a New York, Trump-hating judge, going ahead with sentencing before inauguration day.

This is the judge in the bogus Alvin Bragg trial in New York-

Which found Trump guilty, somehow, of 31 felony counts related to inaccurate bookkeeping. Virtually every prominent lawyer in America dubbed this a ‘false case’ before it ever went to trial.

Bragg took what normally would have been one misdemeanor charge and turned into 31 federal counts-of the same count-

And in doing so, jumped jurisdictions: it was a state trial over violations of what would be ‘federal’ charges. The entire thing was a farce.

And now the judge -who has been delaying a decision on this for months and months- specifically so he could place it right before trump’s inauguration-

On Friday the judge said he’d finally complete the farce with ‘sentencing’ set for January 10th.

In doing so, this judge- Juan Merchan, indicated that he won’t sentence Trump to any jail time-

Which would touch off a constitutional crisis-

But, Merchan insisted, he cannot just drop the case as -even Alvin Bragg and the prosecutor’s office- has suggested.

Merchan is a well-known trump hater. He put trump and his team under all sorts of ridiculous gag orders and rules and- by delaying this sentencing-has also blocked any ability to appeal this farcical conclusion-

This judge is really a slimebag-

And still- ultimately- it’s going to mean nothing.

Legal scholar Jonathan Turley nailed this on Fox news-when he said-

This is simply Merchan playing to the leftist crowd and giving them the gift of being able to label trump a ‘convicted felon’ and/or suggest he ‘got out of jail time’ ...right as he takes office, again.

KAYLEIGH MCENANCY: Constitutional law attorney, Fox News contributor and George Washington Law Professor, Jonathan Turley is here now.

Professor Turley, you always have such a way with words, and you say this is the final cathartic act for lawfare warriors. But these warriors did not just lose the battle, they lost the war. Have they not figured that out at this point?

JONATHAN TURLEY, FOX NEWS CHANNEL CONTRIBUTOR: No, it's very true, Kayleigh. I think that the amazing thing about this order is that it's almost sensing by soundbite. What he is giving to the Trump critics is a label that once he sentences the president-elect, he will technically be a convicted felon, and that will become the new mantra, the soundbite going into the inauguration that this is history being made, even though the president-elect has had no opportunity to appeal this case, which, in my view, is layers of reversible error.

But this is done just before the inauguration, and the timing, by the way, is notable. We've been waiting for him to make this decision. He schedules it just over a week before the inauguration, and then he drops a hint that if he was not able to sentence him before the inauguration, he may just suspend sentencing for four years. I mean, I would call that passive aggressive, but it seems rather actively aggressive.

MCENANY: Yes, it is rather aggressive. But you know, this will allow President Trump to appeal. You mentioned the layers of reversible error. What happens next? Does this make it to the Supreme Court? What's the timeline on that?

TURLEY: Well, it's going to have to go through the New York court system, and there's not a lot of expectations left for most of us in the New York legal system. I'm hoping for the best.

But eventually, it will go to the Supreme Court. But in terms of -- that's the first appeal, in terms of dealing with the sentencing. Now, generally, trial judges have the advantage. The court of appeals courts tend to prefer sentencing to be done so that the case could be finalized.

Turley has said for months that there are numerous avenues for appeal here, by trump and his team. Most ‘fair minded’ legal experts say the case never should have been brought. The path Bragg took is suspect. The verdict is suspect. It’s likely to be overturned on appeal.

But.

But-trump and his team haven’t been able to proceed with appeal -because Merchan has refused to resolve this question of sentencing. And so, the silver lining her for trump and his team is-after this clown finally hands down a sentence-

At least they can finally proceed with the appeal that is likely to have the case and the conviction thrown out.

Why is why-i believe- Alvin Bragg was suddenly okay with having judge Merchan just drop the case.

I don’t think Bragg wants the public shaming and legal criticism that is likely to come his way after this stunt of his, here, hits a ‘real’ court.

Still-Trump was ‘hot’ over the fact that Merchan still won’t just drop this. He called for the judge to be disbarred- in a post on truth social this weekend.

Yep.

And as Turley and Dershowitz and others have said when an appeal is filed-all of Alvin Bragg and judge Merchan’s ludicrous misdeeds, here, will be laid bare.

That day is coming eventually.

Andrew McCarthy is the former federal prosecutor who writes for national review and fox-

And he agrees with Turley on all of this-

The good thing is the appeals process can finally begin after January tenth.

The other good thing is that voters don’t really care.

Sincerely.

Trump, of course, wants to

Clear his name and not have a criminal record based on invented crimes and witch hunts-

But-

The good thing is the American people don’t believe any of this lawfare, anyway.

Aside from a few deep, deep swamp ‘insiders’, no one thinks any of these cases were legit, anyway. The farce of the coordinated witch hunts has long been exposed....and so...aside from a few very low-rated talk shows....no one will care about this.
