Violence and Dems refusal to enforce the law won't help them this fall

I’ve said it before on the show: the only time that i ‘blow’ a prediction is when I give democrats too much credit.

This applies to chief justice John Roberts, too, I guess...because I didn’t think he’d be dumb enough to release the Dobbs decision on a Friday- giving leftist rioters all sorts of ‘free time’ to riot all weekend...but that’s what the dope did.

And so, of course, we saw the riots and protests and you know what?

Aside from LA, Portland and New York, the crowds at these protests in other cities weren’t nearly as large as they should have been if most Americans really cared about this-or found the ruling egregious.

Even here in Milwaukee, the j/s had to report that ‘hundreds of protestors were out.

Hundreds.

In a city of nearly 600-thousand and surrounding suburbs that take the population of Milwaukee County, alone, up to about a million people.

Hundreds of anti-life activists protested. That’s it.

In LA and Portland, we saw more violent protests and ‘wilding’ that led to arrests. Ditto for some of the New York protesting.

Portland is the home base of antifa, of course, and so all sorts of private property damage was done to cars and businesses on the streets.

There were various reports of vandalism and graffiti attacks on pro-life clinics and catholic churches. A clinic in ...Oregon? I believe? Was firebombed. 

So, it was that sort of wilding and occasional destruction this weekend- both nights.

Meanwhile, in Washington DC, anti-life protestors burned the American flag in front of the courthouse...while others took their protests to the homes of the supreme court justices.

On Friday night, the FBI reported that two of the justices had been moved from their homes, over safety concerns. I never did hear ‘which two’, but i know Clarence Thomas’ home was the largest target all weekend, given that he wrote in a concurring opinion that this ruling could be used as a ‘clarifying’ reason to revisit rulings on contraception, gay marriage, and other pro-left decisions.

Protestors were outside his home all weekend.

President Biden and the Biden White House-did-at least issue a statement calling for any protesting to be calm and non-violent...even as other democrat lawmakers were joining the protestors and looking to incite violence. We’ll get to them later, but the list includes AOC and Maxine Waters...

And as expected-the leftists and their democrat leaders spent the weekend misrepresenting what the ruling was: I don’t need to tell this audience that the ruling-does not-ban abortion in America. All it does is-fifty years after a terrible, unconstitutional ruling was made by a previous court-

All it does is turn the issue of abortion back to the states. It re-establishes federalism if you prefer. That’s what this ruling does.

As constitutional scholar Jonathan Turley pointed it: the ruling doesn’t even take a position on abortion. All it ‘takes a position on’ is a terrible decision made by the same court back in 1973. And he’s right.

It is that part of the decision about the ‘due process clause’ that has Clarence Thomas saying in his concurring opinion: look, past courts have used the same clause to legalize gay marriage and several other things. The court should revisit all those decisions.

And so far, Thomas is the only one suggesting it. Alito, in his opinion, makes it clear that this decision overturning roe isn’t meant to be interpreted in any ‘wider’ way here. 

And Clarence Thomas actually agrees with that in his opinion, but says, I personally believe it could be. Hint, hint, to any conservative activist groups who want to try to bring us such cases...

But- the Dobbs decision simply ‘rights’ a 50 year wrong. A mistake the court made 50 years ago that the democrats have been -furiously- protecting ever since.  

We had leftists out all weekend in the streets and in the media screaming about a Trumpist court that’s just exercising it’s raw, ugly, judicial power...

But it’s the opposite that is true.

The democrats-hate- federalism. They hate the idea that one, massive, bullying, totalitarian over-arching government-run by them-doesn’t get to decide how the rest of us get to live...

But this is the correct constitutional call-and everyone who has studied the constitution or constitutional law knows it. Everyone. Even the leftist legal scholars who are pretending to disagree with this ruling...because it gets them face time on CNN or MSNBC.

As one pundit put it: roe was always a house of cards.

Yes. It was. And we’ve talked about that exact thing, over the years, on this radio station and across talk radio and the alternative media.

The Roe decision was one of the worst errors in the history of the Supreme Court: right up there with Dredd Scott, which upheld slavery in 1857. The 13th and 14th amendments overruled it following the civil war...so that egregious error didn’t stand nearly as long as roe did.

Johnathan Turley has a -very good-handle on the ruling, obviously, being a constitutional scholar and a rare ‘middle of the road’ democrat.  

He spent the weekend detailing what the progressives and their left-wing activists were getting wrong.

Yes, we will get to how many of these activists expect joe Biden to now do miracles and somehow ‘codify roe’ via executive orders, and he can’t.

And so, his reactions were all bluster, as were Pelosi’s.

We’ll also talk about how -some of the savvier players in dc on the left are blaming barrack Obama, Nancy Pelosi, and Harry Reid for not codifying roe when they had the chance in 2009. They didn’t take an opportunity to do it, even though Obama ran on the promise.

We’ll talk about that, later, too.  

But it must have really chapped some heinies on the left when Cardinal Dolan and the Catholic Bishops put out a statement celebrating this victory.  

When roe-was-finally overturned on Friday, one of my first thoughts was of cardinal Dolan...and a conversation we had with him when he was still archbishop of Milwaukee, here.

He said many years ago, now, that ‘science’ had already settled the question of ‘when life begins’.  We now have high definition, 3d ultrasound scans that prove that ‘this is a baby’ at a very, very early stage. It bolsters the catholic argument that life begins at conception. It’s also hard to deny it-as a scientific argument.

And so, the cardinal’s take was science has already settled this. Now it’s a matter of getting half of the country to accept it. It’s a matter of changing the hearts and minds of the pro-abortion side of this debate.

But- when does life begin? At what stage of development are you aborting a baby?

Well- science has settled that.

And so, as we see states start to re-evaluate their existing abortion laws, there is no doubt that today’s latest science is going to play a role.

In fact-it is the new laws in the red states that were trying to ban abortions after the point at which that fetus could feel pain...that got us to this decision.

The debate now, in most states who want to keep abortion legal, is going to be ‘can we at least agree on nothing over 15 weeks?’

This, as staunch pro-lifers, and catholic activists will start to focus on banning the abortion pills and chemical abortions.

This is where the debates go now….THE STATES.

Let’s pick up where we left off before the news-

With the Dobbs decision meaning that the questions surrounding whether abortion should be legal...goes back to the states.

We will now see states start to re-evaluate their existing abortion laws.

The left-wing media wants to focus on the red states that might move to ban abortion outright or put strong limits on it.

But it’s also true that the leaders in the blue states are likely to pass the most extreme pro-abortion laws that they can. Several have, already, in anticipation of roe being overturned.

The democrats in NY State practically celebrate the fact that they’ll let you kill a baby at any stage of development now.... right up to the point of birth, or beyond.

New York, California, Illinois...the strongest blue states already have leaders who are trying to market them as travel destinations to have your abortion done.

All this Dobbs decision does is correct a 50 year ‘wrong’

And it is a careful dissertation, but you know the democrats and their leftist activists will never read it. They have no interest in the ‘law’ or the ‘constitution’. They simply ‘want what they want’.

And we saw that in their raging reactions over the weekend. Never, has so much misinformation been spread over a single supreme court ruling.

And most of it was intentional. Meant to enflame the leftist masses. Later, we’ll address whether that is going to work on fall voters...but the short answer is ’no’.

For now, i want to stick to what happens in the states. It turns out that about half of the states already have laws banning abortion on the books, like Wisconsin, or have recently passed laws making it clear-if and when roe is overturned-a statewide abortion ban will take effect.

That’s the situation in Texas and Oklahoma, where their strong conservative majorities in their statehouses passed what are called ‘trigger laws’..

As in...an action by the supreme court-triggers- enforcement of this state law, now. 

And that Texas law doesn’t prosecute any woman or girl having an abortion-it targets the abortionist who is caught performing them in Texas.

If you look at the wider map- it could turn out that about half of the states either ban abortion outright or strictly limit it- while half do not. 

There’s a pro-abortion think tank called the Guttmacher institute...and on Friday...they were suggesting that very little will change because of this ruling-because so many of the -existing- state restrictions on abortion have already created a situation in which women and girls in more restrictive states will travel to those without.

It was also alarming to hear so many government officials over the weekend- proudly state that they were going to refuse to enforce their state’s abortion laws.

We had three of the worst offenders right here in Wisconsin, as Gov Evers, AG Josh Kaul, and Mil DA John Chisholm all vowed to refuse to do their jobs-

Refuse to live up to their oaths of office-

And simply ignore Wisconsin’s existing abortion law.

This is the sort of lawlessness that i point to as the sort of thing that will bring down this republic, if the American people allow it to: we cannot have one side of the aisle simply refuse to enforce any laws that they disagree with-and even boast about it- when they get the chance.

The actions of Tony Evers, Josh Kaul, and John Chisolm this weekend was disgraceful. And frankly, I haven’t been ‘on board’ with the republican gubernatorial candidates who have been vowing to replace John Chisholm if they win election-

I’ve thought that was something best left to the voters-

But not if Chisholm is going to openly flout laws and only enforce the ones he agrees with, no.

So I am now-fully on board-with Gov Nicholson, or Gov Michels, or Gov Kleefisch....removing John Chisolm from office and replacing him with a prosecutor who is going to live up to their oath of office and prosecute cases based on the law, not on their personal values.

I tell yah, Chisolm signing onto this letter with other DA’s should disqualify him for the very job that he’s doing.

It’s unclear to me whether Chisholm will also refuse to prosecute the doctors and clinics who perform abortions in Milwaukee County, but that’s how I read the statement that he signed onto.

And no, it has never been a question of whether we were going to prosecute women or teens who had abortions. That’s another red herring argument the left has used to gaslight the public on this...

No, Chisolm is not being asked to charge individuals who have had abortions: the law is geared toward punishing ‘providers’, and if he won’t do that, he has no business being a DA.

Nor does Dane Co DA Ozanne. Both should have some integrity and resign today if their personal politics are going to keep them from applying the laws equally.

Josh Kaul is even more disgraceful than Chisolm-but we already knew what: Kaul was brought back to Wisconsin to run for a-g, specifically, to be an ‘activist first’ if he managed to win the position, and sadly, he did.

Then there’s Tony Evers-who has zero integrity, anyway. He was at the state dem convention this weekend in La Crosse. Using the ruling as a fundraising opportunity and vowing to pardon any doctor or clinic that-is-prosecuted for violating Wisconsin’s abortion ban, now that it is back in effect.

This is our sitting governor-vowing to go rogue and ignore the law, too.

Not freedom ‘in general’...

And not even freedom when it comes to the abortion issue, no.   The democrats aren’t going to win back enough seats in either chamber of the legislature to ever get close- remotely close enough-to pass new state laws that make abortion legal in Wisconsin or quote codify Roe...as they like to claim.

Nope.

And so, for the time being, unless the republicans in the legislature want to tweak or modify Wisconsin’s long-time abortion ban in Wisconsin-which is now back in effect- no, nothing’s going to change here.

And any democrat candidate for office is lying to you if they suggest it will.

I mean- tammy Baldwin’s speech to the convention was just embarrassing.

This woman. This proverbial backbencher who has never fought for anything in her entire career-

This woman who has never ‘led’ on any issue-ever, much less ‘joined a fight’ and exerted any actual energy on any issue-

In both a larger and a smaller sense-Tammy Baldwin can’t and won’t do diddly.

You democrats in the audience-come on-

Be honest with yourself about Tammy Baldwin. Not only has she never ‘led’ of ‘fought’ for anything, but she’s one of 50 dem senators who don’t have the power to do anything, even if they want to.  When push comes to shove, there are a handful of senate democrats who still have enough sense not to end the filibuster-

And so, the dems can’t force any pro-abortion law thru-

I’d remind you that Chuck Schumer forced a vote on codifying roe recently, and it failed in a bipartisan way...

And in a few short months...the republicans are going to take control of the house, if not the senate, and will be able to block any ‘return to roe’ from happening any time soon.

And so, you democrat voters, as you listen to Evers, Kaul, Baldwin, Moore, Pocan...etc...

As you listen to them over the next few months-raging about roe and promising to do ‘a, b, and c’...

Realize-they can’t do diddly.

They are lying to you.
