The Wisconsin Legislature must pass a joint resolution to end Governor Evers' unlawful, unconstitutional, and apparently unending public health emergency declarations.
Wisconsin Statute 323.10 is abundantly clear: A public health emergency "shall not exceed 60 days, unless the state of emergency is extended by a joint resolution of the legislature." Governor Evers has tried to get around this requirement by issuing new emergency declarations every 60 days, meaning that when the current public health emergency expires in March, Wisconsin will have been governed in a state of emergency for 300 of 372 days without legislative approval. This is both unlawful and an unconstitutional attempt to circumvent the clear letter and intent of state law, and it must be ended immediately.
